Terms and Conditions for StaffBuilder

Welcome to StaffBuilder (“the Platform”). By accessing or using our services, you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you may not use the Platform.

1. General Terms

1.1 Eligibility:
Users of the Platform must be at least 18 years old or the age of majority in their jurisdiction to register, post, or apply for jobs.

1.2 Acceptance of Terms:
By accessing or using the Platform, you confirm your agreement to these Terms.

1.3 Modification of Terms:
StaffBuilder reserves the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting. Your continued use of the Platform constitutes acceptance of the updated Terms.

1.4 No Fees for the First Year:
Users who sign in on or before December 31, 2024 will not be charged registration and job posting fees for their first year of operations.

2. Terms for Employers

2.1 Job Postings:

  • Employers may post job listings free of charge during the first year.
  • Job postings must be accurate, lawful, and comply with applicable regulations.
  • Employers must provide a detailed job description, including qualifications, responsibilities, and compensation (if applicable).

2.2 Prohibited Content:
Employers may not post jobs that:

  • Promote discrimination based on race, gender, age, religion, disability, or other protected statuses.
  • Involve illegal activities or violate applicable laws.
  • Are misleading, fraudulent, or violate intellectual property rights.

    2.3 Interaction with Job Seekers:
    Employers are solely responsible for evaluating and selecting candidates. StaffBuilder does not guarantee the suitability, qualifications, or background of any applicant.

2.4 Data Use:
Employers must use Job Seekers’ data solely for recruitment purposes and comply with data privacy laws.

3. Terms for Job Seekers and Freelancers

3.1 Job Applications:

  • Job Seekers must provide accurate and truthful information in their profiles and applications.
  • Misrepresentation of skills, qualifications, or work history is strictly prohibited.
  • 3.2 Freelance Projects:
    Freelancers may apply for project-based jobs posted by Employers.
  • Once selected, Freelancers and Employers must define the project scope, timeline, and deliverables in writing.

3.3 Prohibited Conduct:
Job Seekers and Freelancers may not:

  • Apply for jobs or projects with fraudulent intentions.
  • Use the Platform for purposes other than legitimate job-seeking or freelancing.

3.4 Responsibility for Deliverables:
Freelancers must ensure that all work is completed according to the agreed terms and timeline. Failure to deliver satisfactory work may result in penalties, disputes, or removal from the Platform.

4. Terms for Completing Agreed Projects

4.1 Agreement Between Parties:
Employers and Freelancers are encouraged to establish a clear written agreement that defines:

  • Project scope and deliverables.
  • Payment terms and schedule.
  • Deadlines and milestones.

4.2 Dispute Resolution:

  • StaffBuilder is not a party to agreements between Employers and Freelancers and does not mediate disputes.
  • In case of disputes, both parties should attempt to resolve the issue amicably or seek legal advice.

4.3 Responsibility for Compliance:
Employers and Freelancers must ensure that their projects comply with applicable laws, including intellectual property and confidentiality obligations.

5. General Platform Guidelines

5.1 User Conduct:
All users must:

  • Refrain from using the Platform for any unlawful or harmful activity.
  • Respect the rights and privacy of other users.

5.2 Content Ownership:
Users retain ownership of the content they upload but grant StaffBuilder a non-exclusive, royalty-free license to display and use the content for Platform operations.

5.3 Liability:
StaffBuilder is not responsible for:

  • The accuracy or legality of job postings or applications.
  • Any direct or indirect losses resulting from the use of the Platform.

5.4 Termination of Access:
StaffBuilder reserves the right to suspend or terminate accounts for violations of these Terms.

6. Limitation of Liability

StaffBuilder is a facilitator and does not guarantee employment or the successful completion of projects. Users acknowledge and agree that the Platform is provided “as-is” and “as-available,” without warranties of any kind.

7. Governing Law and Jurisdiction

These Terms are governed by the laws of Sarasota County, Florida, USA. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Sarasota County, Florida, USA.
